Terms of Service

These Terms of Service (“Terms”) govern your use of legourmetfactory.com (the “Site”), operated by RENT A KITCHEN LLC, doing business as Le Gourmet Factory (“Le Gourmet Factory,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Le Gourmet Factory

Le Gourmet Factory is a food business incubator and shared commercial kitchen serving food entrepreneurs in the New Jersey–New York metro area. The Site provides information about our facility and membership and lets you contact us, request materials, and opt in to communications. The Site does not sell products or process payments.

2. Relationship to the Member Agreement

These Terms govern your use of the Site only. Membership, kitchen access, scheduling, and all payments are governed by a separate written Member Agreement that you sign before any membership or kitchen use begins, and are handled through our third-party booking and billing platform. Nothing on the Site is an offer to contract or a guarantee of membership, pricing, or availability. If anything on the Site conflicts with the Member Agreement on a membership matter, the Member Agreement controls.

3. Eligibility & Acceptable Use

You must be at least 18 years old and able to form a binding contract to use the Site. You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to the Site, its servers, or any related systems.
• Interfere with or disrupt the Site, introduce malicious code, or scrape or harvest data without our permission.
• Submit false, misleading, or fraudulent information, or impersonate any person or entity.
• Use the Site to infringe the rights of others or to transmit unlawful, harassing, or objectionable content.

4. SMS Messaging Program

By opting in, you agree to the following terms for the Le Gourmet Factory SMS messaging program:

1. Le Gourmet Factory may send you two types of text messages: (a) operational messages, such as member updates, booking and reservation confirmations, kitchen access notifications, billing and payment reminders, and account updates; and (b) marketing messages, such as promotions, offers, events, and news. You opt in to operational messages by checking the consent box on our membership or contact form, or during onboarding. Marketing messages require your separate, express written consent through a dedicated marketing consent checkbox; this consent is optional and is not a condition of membership or of any purchase.
2. You can cancel the SMS service at any time. Just text STOP to any message we send. After you send STOP, we will send you a confirmation that you have been unsubscribed, and you will not receive further messages. To re-subscribe, sign up again as you did originally.

4. Carriers are not liable for delayed or undelivered messages.
5. Message and data rates may apply. Message frequency varies and may be up to 15 messages per month across both message types combined. Contact your wireless provider if you have questions about your plan.

5. Intellectual Property

The Site and its content — including text, graphics, logos, the Le Gourmet Factory name and wordmark, images, and layout — are owned by or licensed to Le Gourmet Factory and are protected by intellectual property laws. You may view and use the Site for your own informational and business purposes. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.

6. Third-Party Links & Services

The Site may link to or rely on third-party websites and services, including our booking, billing, analytics, and messaging providers. We are not responsible for the content, policies, or practices of third parties. Your use of those services is governed by their own terms and privacy policies.

7. Disclaimers

The Site and its content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any information on the Site is accurate, complete, or current. Information on the Site is for general purposes and is not professional, legal, or financial advice.

8. Limitation of Liability

To the fullest extent permitted by law, Le Gourmet Factory and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or relating to your use of (or inability to use) the Site. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).

9. Indemnification

You agree to indemnify and hold harmless Le Gourmet Factory and its members, managers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

10. Changes to the Site & These Terms

We may modify or discontinue the Site, or update these Terms, at any time. When we update these Terms, we will revise the “Last updated” date above. Your continued use of the Site after changes take effect means you accept the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in New Jersey, and you consent to their jurisdiction and venue.
